Privacy Policy
Franklin Templeton Investments Australia Limited (FTI) is legally bound by the National Privacy Principles set out in the Privacy Act 1988 (Cth) as amended (Privacy Act). FTI is committed to a culture that respects the privacy of individuals' personal information.
In providing services to you, FTI may from time to time collect personal information from you for the primary purpose of providing you with a range of financial services. Only personal information that is necessary as prescribed by the Corporations Act 2001 (Cth) and relevant ASIC requirements, in connection with the services that FTI offers, or is otherwise necessary for our functions or activities will be collected. In order to fulfill our obligations under the Privacy Act, security measures have been put in place to minimise the risk of misuse, unauthorised access or modification to or loss or disclosure of personal information handled by FTI.
In the course of providing services to you, FTI will use or disclose your personal information for purposes related to the primary purpose for which the information was collected, or where you have consented to the use or disclosure. For example, FTI may
- Use the information for the purposes of rendering services and advice to you
- Share the information with companies related to FTI where these companies assist FTI in providing you with the financial services,
- Disclose information to the following parties:
- Registrars and issuers of securities
- Clearing houses
- Our financiers
- Our custodian of securities
- Other agents appointed by you or us to provide services (whether on your or our behalf) or to us, such as our lawyers, auditors, accountants and other professional advisers and third party service providers not affiliated with FTI
The Privacy Act is not intended to interfere with legal obligations to disclose information for law enforcement and regulatory purposes. Accordingly, FTI will cooperate with all law enforcement bodies in providing information when required.
FTI may also use or disclose your personal information as otherwise required or authorised by law. In each of the above situations, only information that is necessary for each situation would be disclosed.
You can request access to your personal information maintained at our offices by making a written request to our Group Manager-Compliance & Trust Operations. Under the law FTI does not have to accept requests for access in some circumstances. FTI would welcome any changes to your details so as to keep our records up-to-date.
FTI recognises that in certain circumstances the law allows you to elect not to provide your personal information. However, please note that by not providing personal information, FTI may not be able to offer all of our services to you and that any investment advice you do receive will be on a limited basis.
